Single Use License Agreement
This is the Eyeillustrations.com Single Use License, applicable to digital download Customers. If you require the Subscription License or Collections License, please check here.
Definitions
For the purpose of this License Agreement
“Item”, “Items(s)”: All digital works and visual representations furnished to “Customer” (You) by Mark A. Erickson, d.b.a. “Eyeillustrations” (Owner), “JirehDesign.com” (Owner) or “Mark Erickson Art, LLC (Owner). Billing statements ID, “Mark Erickson Art”.
Usage Summary: For each digital work (“Item”) you download, you are granted a non-exclusive license to use the Item in a personal or commercial project, for yourself or your Client, worldwide, on revocable basis, for a Single Use per item purchase. Items MAY NOT be resold, redistributed, or used in multiple significantly different end projects, assets, campaigns or purposes. The license terms start when you submit payment and download the Item and continues for the life of your end project. If your use of the item in your end project ceases, you may not transfer the license to a second project — you should purchase a new license.
Rights: The copyright to the Item(s) remains the exclusive property of Mark A. Erickson, d.b.a. “JirehDesign.com”, “Eyeillustrations.com” (Owner), Mark Erickson Art, LLC. No rights are transferred to the Customer until Mark Erickson Art has received the License Fee in full. Customer and its principals, employees, agents, and affiliates are jointly and severally liable for paying the License Fee to Mark Erickson Art and for other obligations of this License. The only rights for use of the Item(s) granted to the Customer are those specifically set forth in this License. All other rights are reserved by Mark A. Erickson.
THIS IS A LEGAL AGREEMENT between you (Customer) and Mark A. Erickson (the Copyright Owner), d.b.a. JirehDesign.com, Eyeillustrations.com, Mark Erickson Art, LLC. By accepting delivery of the licensed and downloaded Item(s) or animation(s), Customer agrees to be bound by this agreement. If Customer does not agree with these license terms, Customer shall send the image/animation file(s) back to the return address, delete all copies of the Item(s) or animation(s) and Customer’s order will be cancelled.
Metadata: The Item(s) may contain copyright management information embedded in their file. Removing and/or altering this information is prohibited and violates copyright law.
Grant Of License
Eyeillustrations.com (JirehDesign.com), JirehDesign.com, Mark Erickson Art, LLC grants Customer the non-exclusive, non-transferable, limited-sublicensable, revocable license to use and modify the Item(s) subject to the restrictions contained herein. Customer may not re-sell, re-license, rent, assign, transfer, or grant any rights to the Item(s), in whole or in part, or any compilation, derivative or collective work containing such Item(s) to any other person or entity, whether voluntary or by operation of law, without the prior written consent of Mark Erickson, Eyeillustrations.com (JirehDesign.com).
Sublicense: If you use the Item on behalf of a client, you do so by sublicensing these license rights to your one, single client. This sublicense is automatically granted on condition that the use of the Item is limited by the terms of this license. It is your responsibility to inform your client of these license terms. The item must not be extracted or reproduced in any way by or from the client’s end project.
PERMISSION
This license agreement DOES PERMIT the following uses of the Item(s): Customer may use the Item(s) according to the specific terms listed in this agreement and the size purchased by the Customer. The licensed Item(s) and/or video(s) may be used for one single end project. You can make any number of copies of the end project created using the Item. You can distribute the end project containing the Item through multiple media. You can modify or manipulate an Item to suit your end project as long as the Item is being used to represent the original purpose of the Item: to educate and/or demonstrate eye anatomy, disease and or surgery.
Collections
If a licensed Item contains multiple assets (as in Collections), Items within the Collection may be used in different end projects, as long as each individual Item itself is only used in one single end project.
Example: A Collection Item contains an “Optic nerve” illustration item and a “Lens” illustration item. The “Optic nerve” may be used in “Project A” while the “Lens” is used in “Project B”. However, “Optic nerve” may not be used in both “Project A” and “Project B”: a separate license may be purchase of its second use.

Not PERMITTED
This license agreement DOES NOT PERMIT the following uses of the Item(s): Customer or Customer’s client may not post any Item(s) from Eyeillustrations.com (JirehDesign.com) or make the Item(s) available online in a downloadable high-resolution format (without written consent of Mark Erickson), or use the Item(s) in a website at a resolution higher than 72dpi.
You can not use an Item for a Project if you’ve already sublicensed it to a client. A separate license must be purchased.
You can’t claim copyright, trademark or service mark over an item used in your end project You can’t use an Item as a logo or trademark.
You can not redistribute the Item as stock or with source files in a project. You can not redistribute an Item “as-is” or as a standalone Item – even if redistribution is for free.
You can not use an Item for the purpose of allowing a user to customize a digital or physical product to their project or use – such as “made to order” or “on demand”.
You can not use an Item in a commercial use where the Item itself is the primary value. (i.e. “purchase or download this eye illustration” where the item serves as the core component of a product).
- Example of allowed commercial usage: Time and effort has been taken to create a “Human Anatomy” poster where the Items have been modified, labeled or edited in an effort to display the “eyeball” portion of an entire human body.
- Example of NOT allowed commercial usage: An “Eye Anatomy” poster is offered for sale where the Item(s) is(are) the main stand-alone feature of the merchandise.
Items must be used to represent the original purpose of the Item: to educate and/or demonstrate eye anatomy, disease and or surgery. Items may not be used in any way that is fraudulent, offensive, defamatory, pornographic or demeaning.
Using Item(s) from Eyeillustrations.com (JirehDesign.com) in a way not covered or specifically prohibited by this agreement, without prior written consent from Eyeillustrations.com (JirehDesign.com), is a violation of Federal copyright law. This license is in force until it is terminated. If Customer does not comply with the terms and conditions above, this license automatically terminates.
Ownership, Authority. You agree that you will not challenge any aspect of Copyright Owner’s rights in the Items. The Items are protected by copyright and other intellectual property laws and by international treaties. You shall not remove, alter, or destroy any copyright mark or proprietary markings placed on the image.
Videos
Videos are Items, and this license encompasses Video Items. For some Items, a component may be sourced from a third party and a different license may apply to the component, such as stock video “b-roll”. Every effort has been taken to purchase and procure these licenses and they are kept on file by Mark Erickson, Eyeillustrations.com and/or Jirehdesign.com. Where these components are used, the component’s license will apply to that portion of the Item, while this license will apply to the rest.
Copyright
All Item(s) are owned by Eyeillustrations.com (JirehDesign.com) or its licensors and are protected by the United States Copyright laws, international treaty provisions and other applicable laws. No title to or intellectual property rights to any Eyeillustrations.com (JirehDesign.com) Item(s) is transferred to Customer. JirehDesign.com retains all rights not expressly granted by this license agreement.
Warrants and Liability
Eyeillustrations.com (JirehDesign.com) represent and warrants that Mark A. Erickson is the copyright owner of the Item(s) and that Eyeillustrations.com (JirehDesign.com) has not granted any rights in the Item(s) that would permit a third party to raise a claim against the Customer for the Licensed Use. Eyeillustrations.com’s (JirehDesign.com’s) liability for all claims by Customer shall not exceed the License Fee. Eyeillustrations.com (JirehDesign.com) shall not be liable for any general, special, direct, indirect, consequential, incidental, or other damages arising out of Customer’s use of the Item(s). Eyeillustrations.com (JirehDesign.com) warrants the Item(s) to be free from defects in material and workmanship for 30 days from delivery. Customer’s sole and exclusive remedy for a breach of this warranty is the replacement of the Item(s) or a refund of the purchase price, at the option of Eyeillustrations.com (JirehDesign.com). Eyeillustrations.com (JirehDesign.com) makes no other warranty, either expressed or implied, of merchantability, technical, medical or anatomical accuracy, fitness for any particular use or compatibility with any computer or other kind of equipment.
Indemnification:
Customer will indemnify, hold harmless, and defend Mark A. Erickson, d.b.a. “Eyeillustrations.com”, “JirehDesign.com”, “Mark Erickson Art”, its trustees, agents and employees, against all claims, liability, damages, costs, and expenses, including reasonable legal fees and expenses, arising from any use of the Item(s) by Customer.
Disputes:
Any dispute regarding this License shall, in Eyeillustrations.com’s (JirehDesign.com’s) sole discretion, either: (1) be arbitrated in the state of Florida, under rules of the American Arbitration Association and the laws of Florida; or (2) be adjudicated in Florida under the laws of the United States and/or of Florida. Judgment on any arbitration award may be entered in any court having jurisdiction.
Governing Law And General Provisions
This Agreement will be governed by the laws in force in the State of Florida. This Agreement will not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. If any part of this Agreement is found void and unenforceable, it will not affect the validity of the balance of the Agreement, which shall remain valid and enforceable according to its terms. Customer agrees that the Item(s) files will not be shipped, transferred or exported into any country or used in any manner prohibited by the United States Export Administration Act or any other export laws, restrictions or regulations.
This license works in conjunction with the Terms of Use on Eyeillustrations.com. If there are any contradictions between this license and the Terms of Use, this license will apply in those places of inconsistency.
Waiver:
No amendment or waiver of any terms of this License is binding unless set forth in writing and signed by Mark A. Erickson.
This Agreement shall automatically terminate upon failure by Customer to comply with its terms.
